  • Making a Will is the only way that you can be sure that your property will be distributed according to your wishes upon your death.
  • Your Will remains in force until you formally change or revoke it.
  • Your Will is automatically revoked upon entering into marriage.
  • It is a good idea to seek legal advice about a will after separation, marriage or divorce.
  • An Enduring Power of Attorney gives your nominated attorney the authority to manage your financial affairs until you die.
  • An Enduring Power of Guardianship refers to making personal decisions for example, in relation to where you should live and decisions or consenting to or refusing medical treatment. A Power of Guardianship comes into force once the person making the appointment becomes ‘incapacitated’.
  • Powers of Attorney and Guardianship are both arrangements aimed at allowing you to plan ahead and to provide a possible alternative to the involvement of the Guardianship Board at a later stage in your life should you become legally incapacitated.
